FOIA Coordinator Handbook Updated

Posted: Monday, October 3, 2011

In a recent decision, the Michigan Court of Appeals limited the scope of FOIA's potential reach by ruling that a governmental employee's personal e-mails do not constitute public records under FOIA, even if the employee used a government owned system to send the e-mail.

Because of this decision, MMRMA has revised the E-Mail Communication section of its FOIA Coordinator Handbook. The PDF of the handbook under the Members Only section of the website has been updated. In addition, we know that many member employees have attended MMRMA's FOIA training or have otherwise received copies of the handbook. Therefore, we are also providing a downloadable PDF with just the replacement pages, for your convenience.

If you already have a copy of the FOIA Coordinator Handbook, please download the attached two-page file and print it out. These two pages will replace page 3 in your FOIA binder. Page 3 is located in the section under the second tab labeled "Overview & Guidelines." Discard the old page 3 and replace it with the newly downloaded pages 3 and 3a.

If you have any questions about this ruling or the changes to MMRMA's FOIA Coordinator Handbook, email Jack Barron or call him at 734-513-0300.
